What kind of legal things do I need to do in order to be on the safe side when starting my creative business?

I am not a lawyer neither do I have any legal background, so I can just tell you what I’ve experienced myself and trough my clients.

I would always recommend to do some research! Write down everything you want to do with your creative BIZ and do some research what other business owners did legally, then take your research to a lawyer in your country.

Your lawyer will be able to help you make the right decisions for your business.
 

That having said I do think there are a couple of things you should be doing.

 

1.

Create a privacy policy. You should have link to that policy on your homepage and underneath every field where clients can sign up with their email address

2.

Get a policy ready. In that document you will write out the rules that apply when doing business with you. Everything important about payments, rights on intellectual properties of yours and so on! You should read policies of other small business owners to get an idea on what you could have as rules.

3.

In some countries like Germany you have to have certain things on your Homepage and you’re not allowed to do other things. In Germany you need to have a disclosure (Impressum) otherwise you risk to get a penalty. So make sure to let a lawyer check your Homepage. Do some research on those rules, there are probably a lot of pages where you can find information applying to your country.

4.

When working with clients make sure to use written contracts. I know they can be hard to come up with, but it is really smart to just write down on what you’ve agreed upon. In case of disagreements you will have a written version of your agreement.

Talk to a lawyer how you can be on the safe side without having a lawyer creating every agreement you’re going to need.

5.

Make sure to talk to an accountant about starting your business. Make sure you get to know everything about the taxes you will have to pay. Most of the time an accountant also knows about other things you should know about when starting your creative BIZ. So ask them!

6.

In probably every country there’s a government organization that helps you with starting your business. Find that place and ask them all about the legal issues you will have to deal with when starting your business! And of course all the others things you should think about when starting out!

7.

Find out which different legal forms for business exist in your country. Think about what kind of safety you want to have.

Are you planning to be a one person creative BIZ or are you thinking of growing into having employees. Think about those kind of big visions for your business.

Then take a look at all the legal forms a business could have in your country. After doing some research finalize your choice together with a lawyer.

 

So there you have it!

In either case is it smart to just talk to a lawyer about your business. There are special scenarios for every niche, so you have to make sure you’re on the safe side. You don't want to risk your business and a ton of money because you made a little stupid mistake with the legal side of your business.
